PRODUCT DESCRIPTIONS
Aquatic Media Press, LLC and its associates attempt to be as accurate as possible. However, Aquatic Media Press, LLC does not warrant that product descriptions or other contents of this site are accurate, complete, reliable, current, or error-free. If a product offered by Aquatic Media Press, LLC itself is not as described, your sole remedy is to return it in unused condition.
SUBSCRIBER RESPONSIBILITY
Print subscribers are responsible for keeping their mailing address current and inform us promptly of any delivery problems! Log in to our Subscriber Services page to update your contact information anytime. Note that it is the subscriber’s responsibility to provide a secure mailing receptacle such as a mailbox or PO Box.
If a subscriber moves without updating their mailing address with Aquatic Media Press (AMP), the US Postal Service may discard the subscriber’s magazine; periodicals are not forwarded even if a subscriber has set up mail forwarding, and instead, these magazines are noted as “undeliverable as addressed, unable to forward” (UTF). If the USPS alerts AMP that a subscriber’s issue was UTF, AMP will try to confirm the subscriber’s new address and will replace that one (1) issue free of charge. In the case of Canadian and International subscribers, AMP cannot ship a replacement issue, but will instead extend a subscriber’s subscription by one (1) issue free of charge.
If AMP receives a second notice from the USPS, AMP will put this subscriber’s subscription on hold until the subscriber contacts us to properly update the mailing address. Once the subscriber’s address has been updated, the subscription will resume with the next issue on our mailing schedule. Any issues missed will be available for purchase as back issues at current rates; these are not considered part of your subscription. AMP is not responsible for replacing missed issues due to a subscriber’s failure to update their address or inform us within 4 months of the mailing date about a delivery issue.
AMP’s liability is limited to a maximum of one replacement issue, or in the case of Canadian and International subscriptions, a one-issue extension of a subscription.
RETURNED CHECKS AND PAYPAL DISPUTES
A returned check fee of $20 will be charged to subscribers with bounced checks. The fee plus the original subscription amount must be paid in full before the subscription will be activated; fee will be invoiced from Aquatic Media Press.
Please reach out to Aquatic Media Press customer service first before filing a PayPal claim. Customer service can be reached at customerservice@aquaticmediapress.com or toll-free at 1-800-217-3523.
Subscribers are responsible for all PayPal fees incurred Aquatic Media Press as a result of a PayPal dispute that is no fault of Aquatic Media Press (i.e. subscriber has not received their first magazine which has not shipped yet, subscriber does not recognize the PayPal charge, orders shipped through 3rd parties such as freight forwarders, etc.).
In addition to fees assessed by PayPal upon Aquatic Media Press for erroneous claims, a PayPal reversal fee of $20 will be charged to the subscriber by Aquatic Media Press and must be paid before a subscription is reinstated or future orders are honored.
SUBSCRIPTIONS, CANCELLATIONS & REFUNDS
Digital subscriptions solely grant access to the web-based digital reading platform and archives to read through an HTML5-based, web-deployed digital platform (Digital Ediiton). Subscribers are able to test this platform on their devices prior to subscribing through “FREE ISSUE” samples made available on our websites. A subscriber is identified through their unique email address, and access is restriced to this subscriber the immediate family household (spouse, children) of the subscriber. A digital subscription confers a limited, non-exclusive, non-transferable right to access the platform and view the digital content made available on the platform. Digital subscribers can access digital-format magazine issues (digital editions, digital issues) as provided through the platform only while a subscription is active during the timeframe/term of the subscription. Access to the digital platform ends when a subscription expires/is not renewed. Digital subscriptions do not constitute the purchase of a digital copy with an indefinite or lifetime license to personal access of the content on the platform. Lost access can only be restored through the purchase of a new subscription/renewal. Commercial use, sharing digital access with third parties (friends, extended family, etc.), and the redistribution of our digital content is strictly prohibited, and may result in the immediate termination of access and further legal action.
Subscriptions can only be canceled within the first 180 days of purchase. After 180 days, subscription purchases are non-refundable. Digital-only subscriptions are never refundable.
In case of a US-based customer-initiated cancellation of print+digital subscriptions within the first 180 days of purchase, a $20 cancellation fee will be subtracted due to included digital access (which is non-refundable), and the refund of remaining issues that have not yet shipped is prorated based on current retail rates in US$ against the subscription purchase price. For example, if a US-based subscriber paid for a new subscription and cancels after one issue has shipped, the refund is the actual subscription price paid minus 1x $9.99 and the $20.00 cancellation fee.
For Canadian print+digital subscribers, the deduction is calculated at $13.99 per issue and a $30 cancellation fee. All other international print+digital subscriptions are deducted at $16.99 per issue and a $30.00 cancellation fee.
All refunds are processed through the original payment method.
WEBSTORE REFUNDS AND RETURNS
All sales are final, we do not accept any returns. Any refunds will incur a minimum $5 or 5% fee (whichever is greater) as credit card and PayPal fees are not refunded to Aquatic Media Press. All refunds are processed through the original payment method. Note that Aquatic Media Press has to declare international shipments and corresponding custom duties and/or taxes are the responsibility of the customer. Refused shipments are non-refundable.
RISK OF LOSS
If any product ordered from Our Websites does not arrive in good condition, please contact Customer Service to arrange a replacement. Aquatic Media Press, LLC, is not responsible for delivery service delays, circumstances beyond our control, and general “Acts Of God”.
In the event of a lost or stolen magazine issue mailed as part of a subscription, please contact Customer Service. AMP’s liability is limited to a maximum of one replacement issue per 1-year period for U.S. subscribers, or in the case of Canadian and International subscriptions, a one-issue extension of a subscription in a 1-year period. Periodicals shipments are not tracked. AMP does not consider an issue lost until the following issue arrives. AMP is not responsible for replacing missed issues due to a subscriber’s failure to update their address or inform us within 4 months of the mailing date about a delivery issue.
JOBS BOARD
Our Websites and their parent company Aquatic Media Press, LLC, are offering a jobs board (platform) and job postings solely as a service to entities (posters) wanting to post aquarium/aquatic-related job openings to the public and our audience. The platform posts the information supplied by the poster but assumes no risk or liability and does not warrant any information to be correct. Any interaction between the poster and the individual looking for a job based on the platform’s postings is solely between them, and the platform only serves as an information provider for employment opportunties. The platform does not intervene on either the poster’s or job seeker’s behalf and does not endorse any poster or brand, whether explicit or implied. The platform also assumes no risk or warranty regarding federal, state and/or local labor law regulations, wages, worker safety, etc. We reserve the right to reject any posting submitted.

DISPUTES
Any dispute relating in any way to your visit to Aquatic Media Press, LLC or to products you purchase through Aquatic Media Press, LLC shall be submitted to confidential arbitration in Minnesota, USA, except that, to the extent you have in any manner violated or threatened to violate Aquatic Media Press, LLC’s intellectual property rights, Aquatic Media Press, LLC may seek injunctive or other appropriate relief in any state or federal court in the state of Minnesota, USA, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
